The New Mexico cannabis industry has always been about more than just a product; it’s about the culture, the branding, and the small business owners who built this market from the ground up. But a new bill introduced in the 2026 session, House Bill 294, is threatening to strip that identity away.

What is HB294?

Introduced by Reps. Doreen Gallegos, Elizabeth Stefanics, Joshua Hernandez, and Janelle Anyanonu, HB294 proposes some of the strictest packaging regulations in the country. While the goal is ostensibly to protect minors, the methods proposed would place an enormous financial and creative burden on local businesses.

The “Black and White” Problem

The most alarming provision in the bill (Section 2, C-2) would mandate that cannabis packaging be limited to black and white only. This includes text, backgrounds, and even your logos. For small businesses that have spent thousands on brand development and custom packaging, this bill would effectively:

  • Erase Brand Recognition: Small growers would be indistinguishable from massive multi-state operators.

  • Force Costly Rebranding: Every single SKU in your inventory would require a complete packaging overhaul before the January 1, 2027 deadline.

  • Increase Liability: Retailers would be held liable for selling non-compliant packaging, even if they didn’t manufacture it (Section 4).
